An Austin, Texas, man is suing his date for sending text messages after he paid for her to see a 3D showing of Guardians of the Galaxy, Vol. 2 on May 6. His suit is filed against an unidentified 35-year-old woman who was allegedly texting during the film. Vezmar asked her stop, then to leave the theater, which she did - in her auto.
She also told the Statesman, "I'm not a bad woman". I had my phone low and I wasn't bothering anybody.
Vezmar reportedly texted his date days later to ask her for the ticket money, but she refused. It wasn't like constant texting...Are you serious? Unsatisfied with her response, he contacted the woman's younger sister to try and get his money back (the woman is considering filing a protective order). "This is insane." It was the first she had heard of the suit. The woman was unaware of the claim against her until she was reached by phone.
The plaintiff, Brandon Clarke Vezmar, is seeking damages in the amount of $17.31, the cost of two movie tickets.
Although this Texas man might be slightly anal-retentive, texting is against the policy of most theaters, disrespectful to the audience and to your date. When he suggested she go outside to text, the woman departed the theater altogether and left Vezmar without a ride home, he said.

When contacted, the woman said she didn't know that the claim had been made against her and replied "Oh my God".
